Inclement Weather

The weather along the Grand and South Strand is very volatile and changing. It can pour down rain all day and clear up in time for a 7pm session. Or, it can be sunny all day and storm clouds roll in right at the time or the session.

Wind on the beach is expected and under no circumstances will a session be canceled or rescheduled due to wind. The client agrees they understand that although photographer will make every effort to touch up the effects of blowing hair in images, the photographer may not be able to do so without impacting the image negatively.

Booking, Cancelation and Rescheduling

It is understood South Strand Life Photography is the exclusive official photographer retained to perform the photographic services requested on this Contract. It is requested that no cell phone snapping occurs during the session.

Upon booking with required retainer, South Strand Life Photography shall reserve the time and date agreed upon.

Rain and/or thunder/lightning are potential reasons for needing to cancel a session. Due to the volatility of the weather in the south, the photographer will not cancel or seek to reschedule a session until we reach one hour prior to session time. At that time, the photographer will determine whether to hold the session or not and discuss alternate options..

If, in the opinion of the photographer, inclement weather or other adverse conditions prevent the creation of a portrait meeting the artistic standards of South Strand Life Photography, photographer may elect to use an alternate location or to reschedule the portrait session.

If there is lightning, even without rain, the photographer will always err on the side of caution.

The photographer will make every effort to accommodate rescheduling to fit the client's schedule.

If the photographer is unable to offer any other dates during the client's stay in Myrtle Beach, the session will be canceled and refunded 100%.

If the photographer offers an alternate date/time during the client's saty in Myrtle Beach but client does not accept that alternate date/time, the session will be canceled and 50% of the session fee will be refunded to client.

Should the client wish to cancel for inclement weather when the photographer feels the session can still be held, the entire prepaid session fee will be forfeited and a refund will NOT be issued to the client.

Should the client wish to reschedule for any other reason, the photographer will do their best to accommodate the rescheduling, dependent upon room in my schedule. If cancelation is only option, 50% of the session fee will be refunded to the client.

Should the client wish to cancel for any other reason, without attempting to reschedule, the entire prepaid session fee will be forfeited and a refund will NOT be issued to the client.

Should the photographer need to reschedule or cancel due to health or other urgent matter, and the client is unable to accommodate the reschedule request, 100% of fees collected will be refunded to the client.

If South Strand Life Photography cannot perform this Contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness or emergency, then the Photographer shall return any deposit or sitting fee to the Client but shall have no further liability with respect to the Contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event South Strand Life Photography fails to perform for any other reason, South Strand Life Photography shall not be liable for any amount in excess of all monies paid.

Services

A session fee covers the time the photographer spends shooting the photos, basic editing* and preparing an online viewing gallery and the included # of digital downloads specific to the session package booked.

All other products and services are at an additional cost unless otherwise specified in description of session offering.

*Basic editing refers to the adjustment of exposure, shadows, highlights, cropping of images. An effort will also be made to remove other people and beach objects (chairs, umbrellas) from the image, simple hair blown removal and simple glare removal from glasses.

Finished editing would be blemishes, sun burn, tan marks, scars, wrinkles, extensive hair blowing in air or across the face and face swapping between photos and is offered as an additional service at an additional cost.

Studio/Photographer may substitute another photographer to take the photographs in the event of Studio/Photographer’s illness or of scheduling conflicts. In the event of such substitution, Studio/Photographer warrants that the photographer taking the photographs shall be a competent professional.

Products

Prints, canvases and other physical products ordered from the gallery are processed by a third party lab and will be shipped directly to the client from the lab.

South Strand Life Photography guarantees the quality of the products ordered through the gallery. These labs have been vetted against the photographer's style of photography and editing so the products can be guaranteed.

If the client is ever not satisfied with their purchase through the gallery, it should be brought to the attention of the photographer for resolution.

Digital files are immediate and are high resolution and are suitable for printing enlargements.

NOTE: Quality of images printed by a client's lab can not be guaranteed because every lab has their own process.

Consent for publishing and Copyright

No part of any order, including previews, will be delivered until the balance is paid in full.

South Strand Life Photography reserves the right to use images created under this contract for advertising, display, publication or other purposes. The Client agreeing to these Terms and Conditions warrants that he or she has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend South Strand Life Photography in the event of litigation arising out of such use.

Negatives, digital files and previews remain the exclusive property of South Strand Life Photography.

Client is aware that color dyes in photography may fade or discolor over time due to the inherent qualities of dyes, and Client releases Photographer from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities.

The charges in this Contract are based on the Studio’s/Photographer’s Standard Price List. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.

NOTICE OF COPYRIGHT: It is ILLEGAL to copy, modify or reproduce these photographs or videos elsewhere without South Strand Life Photography's permission, and violators of this federal law will be subject to its civil and criminal penalties.

These terms and conditions incorporate the entire understanding of the parties and is governed by the laws of Horry County, South Carolina.

By continuing to book a session via this website, it is understood that the client has read and understand this agreement, including the terms and conditions, and agree to be bound by them.
